PURCHASE PROPOSAL AND CONCLUSION OF THE CONTRACT.
These general conditions of sale concern the purchase of products online on the website www.farmaciagoso.it belonging to:

These conditions of sale can be modified or updated at any time by Farmacia Goso del dr. Alessandro Goso and the buyer undertakes to read them before placing any order.
The reference legislation for distance contracts is present in section II of Legislative Decree no. 206 of 6 September 2005.
The contract will be concluded through access by the user/purchaser to the website www.farmaciagoso.it. Here, following the specified procedure, he will formulate the proposal to purchase the products.
The contract is concluded upon acceptance of the order by Farmacia Goso del dr. Alessandro Goso and the buyer will be notified of the acceptance of the same via email.
By submitting the order, the user implicitly declares that he has read all the information present during the purchase procedure and that he fully accepts the general conditions contained on this page. In case of non-acceptance of the order, the Goso Pharmacy undertakes to communicate it promptly to the buyer.
Once the online purchase proposal has been formulated, the user must print, save an electronic copy or keep these general conditions of sale as required by Legislative Decree no. 206/2005.
Any right of the buyer to compensation for damages or indemnity is denied and any contractual or extra-contractual liability is excluded for any direct or indirect damage to persons and/or things due to the total or partial non-acceptance or fulfilment of the order. All communications to the Goso Pharmacy must be made exclusively to the physical address specified on this page or by e-mail.
1. SALES PRICES AND PURCHASE METHODS (ITALY).
The purchase proposals on the website www.farmaciagoso.it must be made exclusively by users with residence or domicile in Italy, of legal age and in possession of a tax code.
The prices of the products indicated on the website www.farmaciagoso.it, which constitute an offer to the public pursuant to art. 1336 of the Civil Code, VAT and all other taxes are excluded.
The sales prices are valid until the communication of acceptance of the purchase proposal is received. The images of the products on the site are purely indicative. If specific indications are missing in the order notes, the lack of conformity of the purchase cannot be complained about.
With the transmission of the purchase proposal, the purchaser gives his consent to the use by the Goso Pharmacy, for remote communications, of the means of fax, telephone, e-mail.
2. METHOD OF PAYMENT
The buyer can pay for the products ordered using the following payment methods indicated online at the time of purchase:
a) Paypal
If Paypal is chosen as the payment method, the transaction will take place on a server owned by PayPal and can be finalized by the customer by debiting their PayPal account or through a transaction made by credit card, by filling in the fields of the appropriate form on the screen. payment. Any problems relating to the verification of the aforementioned transaction will not be attributable to the Goso Pharmacy which is available to provide the necessary assistance to resolve the problem.

3. AVAILABILITY OF PRODUCTS.
If an order should contain a product in number greater than the quantity of product available in stock in the warehouse, the Goso Pharmacy guarantees the fulfillment of the order in the quantities indicated by the buyer in the shortest possible time.
If it is not possible to find the missing quantity of product, the Goso Pharmacy, after duly informing the purchaser and his express consent, undertakes to replace the missing product with a similar one in terms of composition and desired effect.
If the buyer does not accept the replacement and a longer order completion time, (in any case not exceeding the 30 days provided for by Article 54 of Legislative Decree No. 206/2005), the Goso Pharmacy will send however the goods ordered, provided that the value of the order is greater than or equal to € 50.00 (fifty Euros).
If the buyer does not give his consent to wait the time necessary for delivery (over the 30 days provided for by article 54 of Legislative Decree no. 206/2005) and the residual value of the order placed does not be equal to or greater than €50.00 (fifty Euros), the contract will be considered terminated and the Goso Pharmacy will proceed to immediately cancel the order.
4. METHODS AND COSTS OF DELIVERY.
The Goso Pharmacy will ensure that the products ordered are delivered to the buyers by trusted couriers and/or shippers.
Shipments are made from Monday to Friday, excluding public holidays, Saturdays and Sundays. The delivery of the products takes place within 72 hours from the moment of the conclusion of the order except for Sardinia and the smaller islands where the delivery times are to be considered 96 hours. Upon notification of payment, the products will be ready to be shipped. The pharmacy undertakes to promptly notify the buyer of stock errors or difficulties in finding products that are no longer on the market; in this case he undertakes to return the entire sum received including shipping costs. At the time of shipment, the buyer will be sent a notification email to monitor the purchased goods until they arrive at their home. Upon delivery, the buyer is required to check that the packaging is in good condition, otherwise he is authorized not to accept it, moreover, and if equipped with a camera, he will be able to photograph it, thus certifying the real condition of the packaging at the time of delivery. In the following hours, he will be required to inform the Pharmacy via the address Farmacia.goso26@gmail.com which will resolve the problem as soon as possible.
There are no constraints on the amount to be able to use the Goso Pharmacy service, but the following conditions of sale are understood to be valid: for orders of less than €150, the recipient is charged €5.10 for shipping costs. Over €150, shipping is free. For orders for which the "cash on delivery" payment method has been selected, a contribution equal to the fixed fee applied by the shipper of € 10 is requested.
Summing up:
- Orders of less than €150 in products: shipping costs €5.10;
- Orders over €150: free shipping.
If the buyer chooses the "cash on delivery" payment method, a fixed fee of €10 will be added to the total order.
5. PURCHASER'S OBLIGATIONS.
It is forbidden for the buyer to indicate false and/or fictitious data in the registration procedure for the execution of this contract and the relative communications; personal data and emails must be absolutely real and not belonging to third parties or to fictitious people. Farmacia Goso reserves the right to legally prosecute any violation in this sense and any abuse in the interest and for the protection of all consumers.
The purchaser raises the Pharmacy from any liability arising from the issue of incorrect tax documents due to errors concerning the data provided by the purchaser, the latter being solely responsible for the correct insertion of the same within the site.
The buyer is obliged to accept the jurisdiction of the Court of Imperia for all disputes relating to the application, execution, interpretation and violation of this contract.
6. DATA COLLECTION AND PROCESSING.
By filling in the personal data form in the registration procedure necessary to activate the process of carrying out this contract and the related further communications, the purchaser authorizes the Goso Pharmacy to communicate his non-sensitive personal data (residence, telephone number) to couriers and/or trusted shippers used for the delivery of the purchased products in order to allow the delivery of the orders. These data are processed electronically in compliance with the laws in force and can only be shown at the request of the judicial authority or other authorities authorized for this purpose by law. Personal data will be communicated to subjects delegated to carry out all the activities necessary for the execution of this contract and will be disclosed exclusively for this purpose.
The processing of personal data takes place, also through electronic means, in compliance with the methods established by art. 11 of Legislative Decree 30 June 2003 n. 196 to guarantee the consumer and, in general, to protect his rights, fundamental freedoms and dignity, with particular reference to privacy and personal identity. The data processing will be carried out for the period of time necessary for the fulfillment of this contract. Personal data will not be disclosed to third parties. The user may request the deletion of his personal data by sending a communication by fax or post to the headquarters of the Pharmacy specified on this page.

7. WARRANTIES AND ASSISTANCE METHODS.
The warranty clauses on this page replace any other warranty or condition, other than those provided for by law. All products marketed by Farmacia Goso are covered by the manufacturer's standard warranty and by the 24-month warranty for lack of conformity, pursuant to Legislative Decree n. 24/02. To take advantage of the warranty, the buyer must keep the invoice or transport document received. The manufacturer's warranty is provided according to the methods present in the documentation inserted inside the packaging of the product which is the subject of the warranty or assistance request.
The 24-month guarantee pursuant to Legislative Decree n. 24/02 applies to products that present a lack of conformity, provided that the product itself is used correctly and in compliance with its intended use and with the provisions of the attached technical documentation. In the event of a lack of conformity, Farmacia Goso will replace the product at no cost to the consumer/purchaser.
The 24-month guarantee pursuant to Legislative Decree n. 24/02 is valid for products that present a lack of conformity, provided that the same is used correctly, in accordance with its intended use and with the provisions of the attached technical documentation. In the event of a lack of conformity, Farmacia Goso will replace the product at no cost to the buyer.
If, for whatever reason, it is not possible to replace the product under warranty, Farmacia Goso may proceed, at its discretion and after notifying the purchaser, to send the latter a product of equal characteristics and value or to issue a discount voucher of the same amount that can be spent within 6 months on another item for sale on the site.
This guarantee is transferable only if the current owner provides the original proof of purchase issued by Farmacia Goso. In countries where the limitation of liability is not precluded, the maximum liability of the Goso Pharmacy cannot in any case exceed the price paid by the purchaser for the purchase of the product, except in cases of willful misconduct or gross negligence.
The Goso Pharmacy declines all responsibility for incidental, special, indirect or consequential damages, except in cases of willful misconduct or gross negligence.
The manufacturing defect must be reported within two months of its discovery, under penalty of forfeiture (art. 1519-sexies of the civil code).
The buyer must make a specific complaint following the procedure indicated in point n. 10.
8. RIGHT OF WITHDRAWAL.

Right of withdrawal
You have the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post, fax or e-mail).

To this end, you can also use the model withdrawal form below or our online form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send the communication relating to the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of additional costs deriving from your possible choice of a type of delivery other than the least expensive type of standard delivery from offered to us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not have to incur any costs as a result of such reimbursement
You are requested to return the goods or hand them over to us without undue delay and in any case within 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you return the goods before the 14-day period has expired.
The direct costs of returning the goods will be at your expense. You are only responsible for any diminished value of the goods resulting from handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
WITHDRAWAL EXCLUSIONS
The right of withdrawal is excluded in relation to: a) service contracts after the complete provision of the service if the execution began with the express agreement of the consumer and with the acceptance of the loss of the right of withdrawal following the full execution of the contract by the professional; b) the supply of goods or services whose price is linked to fluctuations in the financial market which the professional is unable to control and which may occur during the withdrawal period; c) the supply of made-to-measure or clearly personalized goods; d) the supply of goods liable to deteriorate or expire rapidly; e) the supply of sealed goods which do not lend themselves to being returned for hygienic or health protection reasons and which have been opened after delivery; f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods; g) the supply of alcoholic beverages, the price of which has been agreed at the time of conclusion of the sales contract, the delivery of which can only take place after thirty days and the actual value of which depends on market fluctuations which cannot be controlled by the trader; h) contracts in which the consumer has specifically requested a visit from the professional for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of this visit, the trader provides services in addition to those specifically requested by the consumer or goods other than the spare parts necessary to carry out maintenance or repairs, the right of withdrawal applies to these additional services or goods; i) the supply of sealed audio or video recordings or sealed computer software which have been unsealed after delivery; j) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications; k) contracts concluded at a public auction; l) the supply of accommodation for non-residential purposes, the transport of goods, car rental services, catering services or services relating to leisure activities if the contract provides for a specific date or period of execution; m) the supply of digital content through a non-material support if the execution began with the express agreement of the consumer and with his acceptance of the fact that in this case he would have lost the right of withdrawal.
The Goso Pharmacy is not liable in any way for damage or theft/loss of goods returned by uninsured shipments; upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the original package and/or packaging are damaged, the Pharmacy will deduct a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution towards the repair costs.
9. CLAIMS.
Any complaint must be forwarded through the form contained in the "contact" section which must be completed in all its spaces. The buyer will receive an email confirming the opening of the complaint within the next three working days; the same email will provide all the instructions for defining the procedure and specify any requests for clarification or documentation to support the claim. As per current legislation, the purchaser, if more than six months have passed since delivery of the product, must provide suitable documentation certifying and providing proof that the lack of conformity existed at the time of delivery. For complaints submitted within six months of delivery, Farmacia Goso reserves the right to verify the actual presence of the alleged defect, before granting the buyer the solution requested by the same or the alternative solution provided for by law.
10. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE.
has the right to terminate the stipulated contract by notifying the purchaser and adequately specifying the reasons; in this case the buyer will only be entitled to a refund of the sum if it has already been paid. The fact that the payment is successful, made by the customer through one of the methods specified in point n.3 of these conditions and the obligations assumed by the customer are of an essential nature, so that the non-fulfillment, by the buyer, of only one of the the aforementioned obligations will determine the legal termination of the contract pursuant to art. 1456 of the civil code, without the need for a judicial decision, without prejudice to the right of Farmacia Goso to take legal action for compensation for any further damages.
11. JURISDICTION AND COMPETENT COURT.
Any dispute relating to the application, execution, interpretation, and violation of purchase contracts stipulated online via the website is subject to Italian jurisdiction. With the exception of the cases provided for by art. 63 of Legislative Decree no. 206/2005, any dispute between the parties regarding the application, execution, interpretation and violation of this contract will be the exclusive jurisdiction of the Court of Imperia.
